Irregular Hours
The FLSA has made provisions for those employees whose duties necessitate working irregular or fluctuating hours. Employers are to provide for overtime in their budgets; such arrangements are known as “Belo contracts.” In order for a Belo contract to exist, the following conditions must be satisfied: the nature of the employee’s duties necessitate irregular hours; the employee’s rate of earning may not be less than the minimum wage level; compensation for overtime should not be less than one and one-half times the regular rate; the contract between employer and employee must provide for a weekly guarantee of pay; and the weekly guarantee must cover no more than 60 hours. Belo contracts should be in writing and provide that such contract applies to compensation only.PRACTICE AREAS:
